Chief Justice, Dipak Mishra, will be reconsidering the case of Judge BH Loya’s death after his discussion with all the four senior judges of the bench. People are keeping their hopes high regarding the case as the approach is on the positive side.
On Tuesday, during the hearing of the case, the two judges expressed their concern regarding the presentation of the case in front of an appropriate panel of judges. This left the decision to be taken by the Chief Justice, whether or not the case needs to be transferred to a different panel of judges.
Justices Ranjan Gogoi, J Chelameswar, Kurien Joseph, and Madan Lokur, the four senior-most judges of the top court announced a press conference where they alarmed regarding the survival of democracy. They expressed that the decision of taking the case to the public was due to the long-term consequences were not addressed accurately. They also expressed that the Chief Justice was influenced in part.
None of the four senior judges were appointed to take care of the Loya’s case. This took a political turn. The case was rather assigned to a 10th most senior judge of the Supreme Court, Arun Mishra.
Arun Mishra expressed his concern that he is being targeted and his competence is in question. He broke down and was reassured that he was not the aim of Justice J Chelameswar.
Chief Justice is not leaving any stones unturned to get connected with the top four judges of the Supreme Court, as they have criticized about his competence and decision regarding the case of Judge Loya, who died at the age of 48, in Nagpur, December 2014, while he was hearing the case of Amit Shah, who was accused with a murder. Later, he was discharged from the case under a new ruling judge.
The scenario is changing that will contribute to a positive output.
